1. General Provisions

These Terms of Service (hereinafter — «Agreement») govern the relationship between the Yasash platform (hereinafter — «Platform», «we») and any person using the Platform (hereinafter — «User», «you»).

Yasash is a product of ООО «YoVA AI» — a software suite for creating and managing online stores within Telegram Mini Apps and Web environments, operating under the laws of the Republic of Uzbekistan.

By using the Platform, you confirm that you have read this Agreement and fully accept its terms. If you do not agree — please discontinue using the Platform.

2. Prohibited Content and Activities

It is strictly forbidden to list stores, products, or content related to:

• Weapons, ammunition, and explosives;
• Narcotic and psychotropic substances;
• Counterfeit and forged products;
• Pornographic and explicitly sexual content;
• Fraud, financial pyramids, and deception of buyers;
• Goods and services prohibited by the laws of the Republic of Uzbekistan;
• Materials inciting hatred, discrimination, or violence;
• Infringement of third-party intellectual property rights;
• Spam and other unwanted mass communication.

3. Blocking and Access Restriction

ООО «YoVA AI» reserves the right, at its sole discretion, to suspend, block, or permanently delete a store and/or User account without prior notice or explanation in the following cases:

• Violation of any clause of this Agreement;
• Posting of prohibited content listed in Section 2;
• Violation of the laws of the Republic of Uzbekistan;
• Complaints from third parties regarding store activity or service quality;
• Request from governmental or law enforcement authorities;
• Detection of suspicious activity threatening the security or stability of the Platform;
• Outstanding debt for the selected subscription plan.

When an account is blocked for violating the Agreement's terms, paid funds are non-refundable and are deemed a penalty for non-compliance. The Platform is not liable for any data loss or damages resulting from such restriction.

4. User Responsibility

The User bears full and exclusive responsibility for:

• Content and products: the content of their store, including accuracy of descriptions, images, current pricing, and the right to use trademarks;
• Quality and fulfillment: the quality of goods and services, their compliance with stated characteristics, timely order fulfillment, and delivery logistics;
• Customer interactions: resolving any disputes and claims from buyers. Yasash is not a mediator, agent, or representative of the User;
• Uzbek legislation: compliance with all applicable regulations, including tax law, distance selling rules, and the Consumer Protection Act;
• Access security: safeguarding control panel credentials and securing connected Telegram bots.

ООО «YoVA AI» is not a party to transactions concluded between the User and their buyers. We do not accept claims regarding product quality, delivery delays, or refunds for goods sold by the User.

Should ООО «YoVA AI» receive claims from third parties or governmental bodies related to the User's activities, the User undertakes to resolve such claims at their own expense and to compensate the Platform for any resulting losses.

5. Limitation of Platform Liability

The Platform is provided on an «as is» and «as available» basis. ООО «YoVA AI» makes no express or implied warranties regarding the Platform or its components.

• Service availability: We do not guarantee uninterrupted, error-free, or high-speed service operation, nor continuous availability during maintenance or outages on the part of providers (including Telegram and cloud data centers);
• Data integrity: The Platform takes measures to protect data but is not liable for full or partial loss due to force majeure, cyberattacks, or technical failures;
• AI-powered features: The Pulse Engine system, automatic background removal, and description generation algorithms are based on probabilistic models. ООО «YoVA AI» does not guarantee 100% accuracy, correctness, or aesthetic suitability of results;
• Third-party services: The Platform is not responsible for the operation of Telegram, payment systems (Payme, Click, Uzum), or other third-party tools required for store functionality;
• Commercial success: We do not guarantee the User any specific revenue, sales level, or customer traffic.

To the maximum extent permitted by Uzbek law, ООО «YoVA AI» is not liable for any indirect damages, lost profits, reputational harm, or data loss arising from the use or inability to use the Platform.

6. Data and Storage

To operate the Platform, ООО «YoVA AI» collects, stores, and processes store data, product and order information, and unique user identifiers (Telegram IDs).

• Pulse Analytics: Data is used to generate analytical snapshots (Daily/Hourly/Live) and optimize the User's business processes;
• Security: We use modern encryption methods to protect transmitted information;
• Confidentiality: The Platform does not share the User's or buyers' personal data with third parties, except as required by Uzbek law or as necessary for technological partners (hosting providers, Click/Payme/Uzum payment gateways) to operate the service.

7. Intellectual Property

The User retains all rights to content uploaded to their store (texts, images, product descriptions). By posting content, the User grants ООО «YoVA AI» a non-exclusive, royalty-free license to display and technically process it within the Platform.

All elements of the Yasash Platform — including source code (Core Engine), graphical interface, design, logos, and database — are the intellectual property of ООО «YoVA AI». The following are strictly prohibited:

• Copying, modifying, or adapting the source code;
• Decompiling or attempting to reverse-engineer the system;
• Using the Yasash trade name for purposes not stipulated in this Agreement.

8. Payment and Subscription

Access to the Platform's extended functionality is based on the chosen subscription plan:

• Free — free (basic functionality, up to 30 orders);
• Start — 295,000 UZS/month (up to 100 orders);
• Business — 595,000 UZS/month (up to 350 orders);
• Enterprise — 1,195,000 UZS/month (up to 1,000 orders).

Payment is made via Payme or Click. Subscriptions renew automatically every 30 days. If automatic billing fails, a grace period (3 days) is provided, after which store functionality reverts to the Free plan.

Paid funds are non-refundable. In the event of a disputed transaction, the User must contact support at @YasashSupport within 3 business days.

9. Changes to the Agreement

ООО «YoVA AI» reserves the right to unilaterally change subscription plan pricing and the terms of this Agreement at any time. The new version takes effect upon publication on the Platform's official website, unless otherwise specified in the new version itself.

The User is personally responsible for regularly reviewing this Agreement for changes. Continued use of the Platform after the new version takes effect constitutes unconditional acceptance of the changes.

If the User disagrees with the changes, they must discontinue using the Platform and disable auto-renewal in the store settings.

10. Final Provisions

This Agreement is governed by the applicable laws of the Republic of Uzbekistan. All disputes shall first be resolved through negotiation. If agreement cannot be reached, the dispute shall be submitted to the court at the place of registration of ООО «YoVA AI».
